49 CFR §391.11(b)(2) requires CMV drivers to read and speak English well enough to communicate with officials, understand signs, and complete required documents.
Active enforcement began June 25, 2025. Drivers who fail can be placed Out of Service immediately.
The driver is placed Out of Service (OOS) and cannot operate the vehicle until a qualified driver arrives. The violation goes on the carrier's record.
Inspectors conduct a two-part evaluation: verbal questions and highway sign recognition. No interpreter apps or translation tools allowed.
Over 7,200 drivers since June 2025. Texas, California, and Oklahoma have seen the highest numbers.
